However, the opinion contains this - "If this case were being heard in a state forum, instead of advancing a separation-of-powers argument, petitioner would presumably rely on federalism and comity concerns, 13 as well as the interest in protecting federal officials from possible local prejudice that underlies the authority to remove certain cases brought against federal officers from a state to a federal court, see 28 U. S. C. § 1442(a); Mesa v. California, 489 U. S. 121, 125-126 (1989). Whether those concerns would present a more compelling case for immunity is a question that is not before us." In Mesa vs California it was determined that the little state guys couldn't sue the Federal Post Office for traffic violations. I'm pretty sure this squares with that.
'Rich people should pay more tax.
RobBlair comments on Nov 18, 2019:
We need to recenter our thinking about taxes. Step one, is this a valid government expense and why? If the free market can solve the problem then it is best to keep the government from screwing it up. Arguing that economy of scale will reduce the overall cost is ignorant considering history. Further, any program you bond into red tape legacy will hamper future progress. Step two, who should pay for it? If this a program that will benefit corporations, then corporations should be taxed for it. If this is a program for individuals then it should be covered by individuals. The program should be proportioned based on the benefit. We should stop using government taxing as a charity proxy. FYI, you Brits each earn 13.8% more than what is shown on your paystub. You earn it and then your employer pays it as a tax. In the US they play that game with our Social Security. I'd like to see some more transparency with the taxing.

RobBlair comments on Nov 13, 2019:
People want a balanced budget too until you start getting specific. I contend that if a libertarian presidential candidate can't primary a republican they will most certainly never be elected (assuming that is even the goal). What libertarian message do you think resonates with the left half of the electorate that wants to take away your guns, make you pay for other kids free college, give expensive healthcare to every one who shows up in our country, etc...? The article makes it fairly clear, if you want a 3rd party, the room is there on the left. A socialist party is already in the Democratic primary under Sanders and Warren (disingenuous as she is). The green party is being given lip service, but its well represented. Except for the Libertarians inability to confer freedom to the unborn, they have little to say that will capture any on the Left and even there you'd have to up the ante by allowing state sponsored executions of even the born as with Virginia and New York. "2020 could be a contest between a socialist and a sociopath." Sure - Trump is a sociopath because the media tells you that ceaselessly. Just what do you think happens when your ideal pristine untested Libertarian threatens the Democrat and becomes their target? Give me more Rand Pauls.

If truth exists then there is still a meta-narrative to follow and post modernism is defunct. Yes, our perception of truth is varied and often flawed. But, the excuse that postmodernism provides, that we must ingest lies and allow ourselves to be fed false narratives, will be of little solace when we eventually hit ground after jumping from the cliff. It is contingent upon each individual to cull the liars from their lives and face the harshness of reality with courage.

We have even been advised locally thatthe best way to get our supplies u~ the river would be to fly the Turkish flag, which would be respected by the tribesmen." - Winston Churchill "Churchill came to believe that giving the Kurds their own independent territory would be contradictory to the British desire to retain control of the oil rich area, and to the Arab aspiration to rule the entirety ofIraq. Another concern that vexed Churchill was the persistent threat of Soviet intervention in Persia, which forced the Secretary to maintain a large military presence in the area to thwart any attempt by the Soviets to seize the oil-rich country. This large military presence ran contrary to his desire to reduce the large standing British armies in the theater due to the enormous cost to the treasury." - https://ntrl.ntis.gov/NTRL/dashboard/searchResults/titleDetail/ADA491318.xhtml#

What makes it harder for college students and other transient people to vote, in this case, is establishing residency. Each locality (Democrat and Republican) provides its own rules for determining who is included as part of the group and who isn't. As a resident, that person has skin in the game for electing local officials, establishing local state sponsored charities (like reduced college tuition for state colleges), local taxes, etc... A record number of college educated students are graduating with useless degrees that they can't afford to pay back. They are financially strapped, unable to make a living and are looking forward to life choices that provide little hope. I want the next generation to rise into a hopeful future where they can meaningfully participate. The left only seems to think about capturing this voting block with the promise of "free." It is a harder sell but the future of both those options seem obvious: Plumbers, carpenters and mechanics with a prospering family life or ungrateful college grad protesters who live alone.

Public incitement of hatred 319 (1) - Every one who, by communicating statements in any public place, incites hatred against any identifiable group where such incitement is likely to lead to a breach of the peace is guilty of: [a] an indictable offence and is liable to imprisonment for a term not exceeding two years; or [b] an offence punishable on summary conviction. Identifiable group means any section of the public distinguished by colour, race, religion, national or ethnic origin, age, sex, sexual orientation, gender identity or expression, or mental or physical disability. Thoughts - Does incitement require intent? Subsection (2) is entitled "Wilful Promotion of Hatred" and provides a glaring contrast to section (1) above which has no language that requires intent. What is the threshold for "likely to lead to a breach of the peace"? I'd suggest that any historical connection between certain language and violence would set an appropriate threshold. What should Canada do? Plan A, get rid of Boy Thureau is apparently too difficult. Plan B, enforce this law mercilessly. Any and every public statement that contains even a hint of saltiness, from any leftist organization, college, or supporter of this lunacy should be hauled up for trial. Freedom loving Canadians should start a legal "defence" fund to promote the prompt removal of this statute. In this case, the promotion of the rainbow poppy is inciting hatred towards the Veterans of Canada and people with a normal sexual orientation. At that point, the girls return to the girl's sports teams (I suggest a flip sign for the locker rooms) and the boy who identifies as a trans girl who now identifies as a non-trans girl can be on his very own team and win first place every time. I know I know, because "What happens if there are two boys who identify as trans girls and only one chooses to re-identify as a non-trans girl? Dressing up as an Hasidic Jew is offensive and causes a Jewish student to come to tears. Someone better let Mel Brooks know that the Leftist Nazis are coming for him. Dressing up in a black ski mask with a label "absent father" is offensive. It is completely right to be ashamed of a heritage that now stands with a fatherless rate of 70%. On the other hand, instead of working to reverse this devastating statistic, white fathers are joining in. A great opportunity to open an important dialog that our secular amoral schools are allergic too. Perhaps lashing out against this student and his parent(s) is their only defense. Perhaps we should entertain the comedic perspective a bit more so that we can cut through this pretend, or at the best, undermining outrage.

Are you still following what's happening in Hong Kong?
RobBlair comments on Nov 6, 2019:
A sad situation from the get go. Mapping out a resolution to that conflict, that would end with a free Hong Kong, does not exist outside of conflict, death and destruction. Once Britain surrendered its sovereignty this situation was inevitable. However, where people's basic freedoms are suppressed, I support their actions that would accomplish that freedom. I couldn't imagine a world where my self expression was subject to discipline by the state.

They will need to clear Hong Kong first. Another thought, the Chinese have been kept from the truth. They start losing their only sons at the same time they are watching Chinese tanks roll into Beijing during the Tiananmen Square protest (as well as other broadcasted information) and some of the enslaved may very well start waking up.

Exception – military arms and materiel that are purposely excluded from domestic use. Why should police be afforded "high capacity" magazines and specialized ammunition? Are we going to pretend that the criminals will abide by these new restrictions? The criminals won't afford themselves body armor when they rampage against us? Is not our right to self defense a human right that should most certainly be supported by our servants in government? Who in government will pay the price when this extra-legislative practice gets a citizen killed?

Masked gangmen repeatedly ring doorbell in an effort to harass. I could see that as attempted assault. This group has a history of assault, they outnumber the occupants of the house. They are showing a clear indication of aggression. If they produced a weapon or started kicking the door, I'd think a non-Biden shotgun blast could be defensible. I almost think that these socialists would relish one of their own being "martyred" (as long as it wasn't them).

This will probably be sacrilegious but I am on the outside looking in and (clearly) speak from ignorance. I've always seen the Marines as a transitional force. They are a transition between the Navy and the Army. And, they cover the transitional war zone between oceans and land. If its an island or you need a beach head then its the Marines you need. If its a boarding operation or defending a ship then you want Marines. If its an extended land war, I would think the Army should take point. I read the article and I still don't know what the Navy needs from the Marine Corp. Maybe some kind of River Boat action, forward observers for directing Naval ordinance, placating ground to ship defenses.

Reconstruction - A time when single motherhood wasn't a thing. The NRA was used to distribute weapons to black (Republican) communities to defend against the white Democratic Paramilitary wing, the KKK. When the newly risen Democratic President took the reigns he used his position to pardon white southerners and undo many efforts in reconstruction. Johnson's impeachment was also the act of an over enthusiastic congress that refused to recognize the legally imposed boundaries. Yes, it was white southern Democrats who imposed poll taxes and literacy tests to exclude blacks from voting.

Anyone who teaches this course should be charged with enslaving minors. Here is a list of the top 20 mathematicians as ranked by people in the mathematical know - https://en.wikipedia.org/wiki/Human_Accomplishment#Mathematics Most people would focus on their accomplishments that have forwarded the human race into a better understanding of the natural world. The only thing that will be accomplished by focusing on race (all white) is either attempt to correct for history or foster racial resentment. And most importantly, distracting the students with the above history instead of learning math (the kind that landed humans on the Moon) will all but assure the student never becomes a scientist, engineer, programmer, etc... So evil.

Is democracy better served by compulsory voting or non-compulsory voting?
RobBlair comments on Oct 29, 2019:
I think the most damaging aspect of compulsory voting is that it makes the government the master over its citizenry for an unnecessary function. Political speech and expression should not be under any sovereign's boot.
